These Terms of Service (the “Terms”) are an agreement between you and the team that runs NextQuiz (“NextQuiz”, “we”, “us”). They cover the NextQuiz website at nextquiz.atuandev.com, its Live Games and every other part of the service (together, the “Service”). By using the Service as a User or as a Guest, you agree to these Terms. If you don’t agree, please don’t use NextQuiz.
Our Privacy Policy explains what we collect and how we use it. It is part of these Terms.
1. Words we use
- User: someone signed in with a Google account. Guest: someone using NextQuiz without signing in.
- Creator: a User who builds a Quiz. Host: a User or Guest who opens a Lobby and runs a Live Game. Player: anyone who joins a Live Game, usually with a Game PIN.
- Quiz: a set of questions and slides, with its name, description, cover and media. Live Game: one real-time session of a Quiz, from the Lobby to the Podium.
- Player Card: the nickname and Mascot a Player picks to join a Live Game.
- Your Content: anything you add to NextQuiz, such as Quizzes, questions, uploaded pictures, nicknames, your display name and ratings.
2. Who can use NextQuiz
You must be at least 13 years old, or the minimum age to use online services without parental consent where you live if that is higher, to create an account. If you are under 18, you confirm that a parent or guardian has read these Terms with you and agrees to them.
Younger children may join a Live Game as a Guest only under the supervision of a parent, teacher or another responsible adult. A Guest Player shares nothing more than a nickname and a Mascot, and we ask Hosts not to require anything else.
You may not use NextQuiz if the law where you live forbids it, or if we have previously closed your account for breaking these Terms.
3. Your account
You sign in with Google; we never see or store your Google password. You are responsible for everything that happens through your account, so keep your Google account secure and tell us at atuandev@gmail.com if you think someone else has used it.
Your account is personal. Don’t share it, sell it, or create an account on someone else’s behalf without their permission. Your display name must follow the content rules in section 6.
4. Hosting and playing Live Games
Anyone with a Game PIN, a Lobby link or the Lobby QR code can join a Live Game, so treat the PIN like an invitation: share it only with the people you want in the room.
- Hosts control their Live Game. A Host can start, pause, skip ahead, end the game and remove a Player at any time.
- Nicknames, Mascots, answers, scores and ranks are visible to everyone in the same Live Game, including on any screen the Host shares or streams.
- Pick a nickname that is not your full name or any other personal information, and that follows the content rules in section 6.
- Play fair. Don’t join with bots or scripts, flood a Lobby with fake Players, or interfere with other Players’ answers.
- Hosts who run Live Games for a class, a company or an event are responsible for having any permission they need from the Players, their school or their organisation.
5. Your Content
You keep ownership of Your Content. To run the Service, you give NextQuiz a worldwide, non-exclusive, royalty-free licence to store, copy, display, adapt (for example, to resize a picture or fit text on a slide) and distribute Your Content, only as needed to operate, secure and improve NextQuiz. This licence ends when Your Content is deleted from the Service, except where it has already been shared with others as described below, or where we must keep it by law.
Visibility
- Private (the default): only you can see and host the Quiz.
- Unlisted: anyone with the link can open and host the Quiz, but it is not listed in discovery or search.
- Public: the Quiz is listed on NextQuiz and may appear in search engines. Anyone, including a Guest, can open it and host it as a Live Game.
When you publish a Quiz, NextQuiz keeps each published Quiz Revision so Live Games that used it, and their results, stay accurate. Answers Players gave in a Live Game remain part of that game’s results.
You confirm that you own Your Content or have every right needed to use it this way, and that it does not break any law or anyone else’s rights.
6. Content rules
Don’t create, upload or share anything on NextQuiz that:
- is illegal, or promotes or helps with illegal activity;
- sexualises or endangers minors in any way, or is sexually explicit or pornographic;
- harasses, bullies, threatens or humiliates anyone, or promotes violence, self-harm or terrorism;
- attacks people for their race, ethnicity, nationality, religion, gender, sexual orientation, disability, age or similar characteristics;
- shares someone else’s personal information, such as their address, phone number or private pictures, without their permission;
- infringes copyright, trademarks or other rights, for example a picture you have no right to use or another quiz copied without permission;
- impersonates a person or organisation, or misleads Players about who you are;
- is spam, advertising or a scam, or contains malware or links to harmful sites.
We don’t review every Quiz before it is published, but we may remove or hide any content that breaks these rules, or that we reasonably believe puts people or the Service at risk.
7. Using the Service fairly
You agree not to:
- copy, scrape or collect Quizzes or other people’s information from NextQuiz with automated tools, except search engines that follow our robots rules;
- overload, attack or disrupt the Service, or try to get around its limits, security or access controls;
- probe, scan or test the Service for weaknesses without our written permission (if you find a security issue, please report it to atuandev@gmail.com);
- reverse engineer the Service, except where the law allows it despite this restriction;
- use NextQuiz to build a competing service, or resell access to it;
- use the Service in any way that breaks these Terms or the law.
8. Media and services from others
The editor lets you search pictures from Unsplash and GIFs from Giphy, and add video clips from YouTube. That media belongs to its owners and is offered under their own terms: Unsplash, Giphy and YouTube. Signing in uses Google, under Google’s terms. We are not responsible for those services or for websites linked from a Quiz.
9. Copyright complaints
If you believe something on NextQuiz infringes your copyright or other rights, email atuandev@gmail.com with:
- your name and how to contact you;
- the work you believe is being infringed;
- the link to the Quiz or content on NextQuiz;
- a statement that you believe in good faith the use is not authorised, and that your notice is accurate and you own the rights or act for the owner.
We will review the notice, may remove the content, and may close the accounts of people who repeatedly infringe others’ rights.
10. Ratings and feedback
Ratings you give a Quiz are shown as part of its average rating. If you send us ideas or suggestions, we may use them to improve NextQuiz without owing you anything for them.
11. What belongs to us
The NextQuiz name, logo, Mascots, design, software and everything else we create for the Service belong to us or our licensors and are protected by law. These Terms don’t give you any right to use them, other than using the Service as intended.
12. Price
NextQuiz is free to use today, so there is nothing to buy, cancel or refund. If we ever offer paid features, we will explain the price and terms clearly before you pay, and you won’t be charged without agreeing first.
13. Changes to the Service
NextQuiz is growing, and features will be added, changed or removed. We may also pause the Service for maintenance or for reasons beyond our control. When a change takes away something important, we will try to tell you in advance where we reasonably can.
14. Suspension and closing your account
You can stop using NextQuiz at any time. To close your account and delete your data, email atuandev@gmail.com from the address you sign in with.
We may remove content, end a Live Game, or suspend or close an account if you break these Terms, if the law requires it, or if it is needed to protect Players, other Users or the Service. Where it is reasonable and safe, we will tell you why and give you the chance to respond.
Sections 5 (for content already shared), 9, 11 and 15 to 19 still apply after your account is closed.
15. No warranties
We work hard to keep NextQuiz running and accurate, but the Service is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will always be available, error-free or secure, or that Quizzes made by others are accurate, appropriate or suitable for your purpose. Quizzes are made by Creators, not by NextQuiz, and don’t reflect our views.
16. Limitation of liability
To the extent the law allows, NextQuiz is not liable for any indirect, incidental, special or consequential loss, or for loss of data, profit or goodwill, arising from your use of, or inability to use, the Service, even if we were told it could happen. Because the Service is free, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, if any.
Nothing in these Terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence, or takes away your rights as a consumer.
17. Indemnity
If someone makes a claim against NextQuiz because of Your Content or because you broke these Terms or the law, you agree to cover the reasonable costs and losses that result, to the extent the law allows.
18. Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam. If you have a problem with NextQuiz, please email atuandev@gmail.com first: most issues can be solved quickly that way. If we can’t resolve a dispute within 30 days, it will be settled by the competent courts of Vietnam. If you live elsewhere, you keep any protection the mandatory laws of your country give you as a consumer.
19. Changes to these Terms
We may update these Terms as NextQuiz changes or the law requires. The date at the top shows when they last changed. For significant changes, we will tell signed-in Users on NextQuiz before they take effect. If you keep using the Service after the changes take effect, you accept the new Terms; if you don’t, please stop using NextQuiz.
20. General
- These Terms and the Privacy Policy are the whole agreement between you and NextQuiz about the Service.
- If any part of these Terms can’t be enforced, the rest still applies, and the unenforceable part is applied as closely to its intent as the law allows.
- If we don’t enforce a right straight away, we haven’t given it up.
- You may not transfer your rights under these Terms to anyone else. We may transfer ours if NextQuiz is taken over or reorganised, and these Terms will continue to protect you.
- If these Terms are translated, the English version applies where the translations differ.
